Introduction

GetTheData Publishing Limited maintain and publish an online archive of publically-available company information, which includes personal information identifying the officers and persons of significant control for each company.

Whilst we do not tend to delete information from our archive on the basis that our processing is necessary for compelling legitimate grounds, and that our service constitutes a historical archive maintained in the public interest, you can request that your company's page is removed from search engines. You can do this by emailing [email protected].

Company information is provided to us by Companies House.

In their Personal Information Charter, Companies House state that:

Before becoming an officer of a company or other entity, it’s important that you’re familiar with the legal implications. As a company officer, we’re required by law to publish some of your personal data on the register. The register is publicly available and accessible by anyone.

Companies House also make clear that they will transfer personal information to third parties (such as GetTheData Publishing Limited):

Commercial organisations sometimes use data from the register to create their own online products. These organisations then become controllers of your personal data.

The lawful basis for us processing company records including personal data is legitimate interest.

Our services also constitutes a historical archive maintained in the public interest, which exempts us from the below GDPR provisions as per this ICO guidance:

Archiving in the public interest

This exemption can apply if you process personal data for archiving purposes in the public interest.

It exempts you from the GDPR’s provisions on:

  • the right of access;
  • the right to rectification;
  • the right to restrict processing;
  • the obligation to notify others regarding rectification, erasure or restriction;
  • the right to data portability; and
  • the right to object.

The GDPR also provides exceptions from its provisions on the right to be informed (for indirectly collected data) and the right to erasure.

A healthy corporate ecosystem depends on transparency regarding who owns and operates the companies within it, enabling those individuals and entities to be easily identified - and held to account if necessary.

This transparency is essential in establishing trust between companies and their stakeholders: It is manifestly in the public interest.

The public interest benefit should be balanced with the privacy interests of the individals concerned: The impact on individual privacy is objectively minimal as all personal information is already and the public domain and readily available online via Companies House. The personal information was placed in the public domain with the knowledge and consent of the subject when they took up their position as company officer or shareholder.
